Terms of Service

Please read these Terms carefully. By accessing or using the Service you agree to be bound by them. If you do not agree, do not use the Service.

1. Who we are & acceptance

These Terms are a binding agreement between you and the operator of The Philosopher Investor (“The Philosopher Investor,” “we,” “us,” or “our”). They govern your access to and use of thephilosopherinvestor.com, the companion dashboard at app.thephilosopherinvestor.com, and our Substack publication, together with any related sites and communications (the “Service”). Our full legal entity details appear at checkout through our payment processor. By using the Service you confirm you are at least 18 and have the legal capacity to enter into these Terms.

2. What the Service is

The Philosopher Investor is an educational market-analysis service. It includes a web dashboard with screeners, a market scanner, stock detail views, and watchlists, plus a Substack newsletter with market commentary and trade ideas. Some features may be free; their scope can change at any time. We may modify, suspend, or discontinue any part of the Service at our discretion. All content is for educational and informational purposes only and is not investment advice.

3. Accounts & access

You sign in with a one-time magic link sent to your email address. There is no password to remember. You are responsible for the security of your email inbox and for all activity under your account. We may restrict, suspend, or terminate access for any reason, with or without notice, including for conduct violations or non-payment.

4. Subscriptions, payments & refunds

Paid access is sold and billed through Substack and its payment processor. We never receive or store your full card number.
Because the Service is digital and informational, all sales are final and no refunds are issued.
You manage and cancel your subscription in your Substack settings. Cancel before your next billing date to avoid the next charge.
Any trial converts to a paid subscription at the end of the trial unless you cancel first.

5. Investment & financial disclaimers

We are not a registered investment adviser or broker-dealer, and we do not provide personalized investment advice. Nothing in the Service is a recommendation to buy or sell any security for any specific person. Trade ideas and callouts are educational examples. We strongly suggest practicing any idea on a paper-trading account first; live trading is entirely at your own risk. Past performance does not predict future results, and profitability is not guaranteed. Trading stocks and options carries significant risk and is not suitable for everyone. You assume the full cost and risk of any trade you make, and you should consult a licensed financial professional before investing.

6. Hypothetical and backtested results (CFTC Rule 4.41)

Some content shows backtested or simulated results. Hypothetical performance has inherent limitations. Unlike a real track record, simulated results do not reflect actual trading and may under- or over-compensate for factors such as liquidity. Because the trades were not actually executed, results may differ materially from live trading, and they are prepared with the benefit of hindsight. No representation is made that any account will or is likely to achieve similar profits or losses.

7. Acceptable use

You agree not to:

Post or transmit unlawful, harmful, abusive, harassing, or misleading content.
Impersonate us, our staff, or any other person.
Send spam or unauthorized promotion, or solicit our members for competing services.
Interfere with the normal operation or security of the Service.

8. Intellectual property

The Philosopher Investor brand, content, scores, rankings, analysis, methodology, and materials are our property and are protected by law. We grant you a limited, non-exclusive, non-transferable right to share select insights on social media, provided you clearly credit The Philosopher Investor as the source. This does not permit systematic or commercial redistribution of our data.

9. Proprietary data & no scraping

You may not use any bot, spider, script, or automated tool to scrape or extract data from the Service.
You may not redistribute, republish, or mirror our scores, rankings, analysis, or trade ideas to other platforms, public forums, or private groups.
Unauthorized redistribution may result in immediate termination and may be treated as a licensing request billed on a case-by-case basis.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any data or analysis will be accurate, complete, or current.

11. Limitation of liability & indemnification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS OR TRADING LOSSES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM. You agree to indemnify and hold us harmless from any claims or costs arising from your use of the Service or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of competent jurisdiction in the United States.

13. Changes & termination

We may update these Terms from time to time and will revise the effective date above. Your continued use after a change means you accept the updated Terms. We may suspend or end your access at any time for breach, non-payment, illegal activity, or at the request of law enforcement.
